TERMS AND CONDITIONS
These Terms and Conditions (these “Terms”) govern access to and use of the FixedOps Innovations website, contact forms, business communications, public resources, and other public-facing materials made available by FixedOps Innovations, LLC (“FixedOps Innovations,” “we,” “us,” or “our”).
These Terms apply to website visitors, prospective clients, business contacts, and other individuals or entities that access or use FixedOps Innovations’s public-facing website, communications, or resources. Client access to and use of FixedOps Innovations products, platform functionality, software, support, implementation, monitoring, processing, or other client services may be governed by separate agreements, including a Master Services Agreement, Activation Agreement, Data Processing and Security Addendum, Service Level Agreement, Support Policy, or other applicable service documents.
1. Website and Public Resources.
The FixedOps Innovations website and public resources are made available for general business informational purposes. FixedOps Innovations may update, modify, suspend, or discontinue any portion of the website or public resources at any time.
Users may access and use the website and public resources only for lawful business purposes and in accordance with these Terms.
2. Business Communications.
If a user contacts FixedOps Innovations, submits a form, requests information, schedules a meeting, or otherwise communicates with FixedOps Innovations, we may use the information provided to respond to the inquiry, coordinate follow-up, support onboarding, manage business communications, and operate its business.

3. SMS Messaging Terms.
FixedOps Innovations may offer text message communications in connection with its website, business communications, onboarding activities, support, account administration, demos, operational communications, and related business purposes.
By providing a mobile phone number and affirmatively opting in to receive text messages from FixedOps Innovations, the recipient agrees to receive text messages from FixedOps Innovations for service-related, support, onboarding, account, demo, operational, and administrative communications.
Message frequency may vary. Message and data rates may apply. Consent to receive text messages is not a condition of purchase. Recipients may opt out of text messages at any time by replying STOP. Recipients may request assistance by replying HELP or by contacting FixedOps Innovations through the contact information made available on its website.
Mobile phone numbers, mobile opt-in information, and text messaging consent will not be shared with third parties or affiliates for marketing or promotional purposes. All categories of data sharing described in this Privacy Statement exclude text messaging originator opt-in data and consent.
4. No Professional Advice.
Information on the FixedOps Innovations website or in public-facing materials is provided for general informational purposes only. Such information does not constitute legal, regulatory, compliance, financial, tax, insurance, warranty, or other professional advice.
Users, Clients, and prospective Clients remain responsible for consulting their own advisors and making their own business, legal, compliance, operational, and customer-facing decisions.
5. Client Services Subject to Separate Agreements.
Access to and use of FixedOps Innovations products, platform functionality, software, support, implementation, monitoring, processing, or other Client Services may require a separate written or electronic agreement with FixedOps Innovations.
If there is a conflict between these Terms and a signed or electronically accepted agreement between FixedOps Innovations and a Client, the agreement will control with respect to the applicable Client Services.
6. Intellectual Property.
As between FixedOps Innovations and the user, FixedOps Innovations owns and retains all right, title, and interest in and to the website, public resources, content, text, graphics, logos, designs, software, workflows, product names, service names, documentation, technology, know-how, and other materials made available by FixedOps Innovations, including all related intellectual property rights.
No rights are granted except as expressly set forth in these Terms or otherwise agreed by FixedOps Innovations in writing. Users may not copy, modify, distribute, reproduce, reverse engineer, scrape, harvest, sell, sublicense, or otherwise use the website, public resources, content, software, or materials except as expressly permitted by FixedOps Innovations in writing or as permitted by applicable law.
7. Acceptable Use.

FixedOps Innovations makes no warranties, whether express, implied, statutory, or otherwise, regarding the website, public resources, availability, accuracy, completeness, reliability, timeliness, security, or suitability for any particular purpose.
FixedOps Innovations specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, and any warranties arising out of course of dealing or usage of trade.

Continued access to or use of the website or public resources after updated Terms are posted means the user accepts the updated Terms.

These Terms will be governed by the laws of the State of Delaware, without regard to conflict of laws principles.
